Terms of Service

Please read these Terms of Service carefully before using Stayva. By accessing or using the service, you agree to be bound by these terms. If you do not agree, do not use the service.
1. Definitions
| "Service" | The Stayva web application and associated APIs |
| "User" / "You" | The PG owner, manager, or staff member who registers for the Service |
| "Tenant Data" | Personal information of PG residents entered into the Service by you |
| "We / Us / Our" | Stayva and its operators |
| "Platform" | The software, APIs, and infrastructure that power the Service |
2. Eligibility & Acceptable Use
- •You must be at least 18 years old and a legally registered PG/hostel operator to use this Service.
- •The Service is intended solely for managing PG / paying guest accommodation businesses.
- •You agree not to use the Service for any unlawful purpose or in violation of any applicable Indian laws.
- •You must not share your login credentials with unauthorised persons.
- •You are responsible for all activity that occurs under your account.
- •You agree not to attempt to reverse-engineer, scrape, or access the API in ways not expressly permitted.
3. Your Data Responsibilities
As the party entering tenant data into the Service, you are the Data Fiduciary under the DPDP Act 2023 with respect to your tenants' personal information. This means:
- ⚠You must obtain explicit, informed consent from each tenant before entering their personal data.
- ⚠You must inform tenants about the purpose of data collection (KYC + tenancy management).
- ⚠You are responsible for responding to tenant requests for data access, correction, or erasure.
- ⚠You must not upload fraudulent, forged, or misappropriated identity documents.
- ⚠You must comply with UIDAI regulations regarding Aadhaar — only masked/virtual IDs should be stored.
4. Account Security
- ✓You are responsible for maintaining the confidentiality of your password.
- ✓Notify us immediately at support@stayva.in if you suspect unauthorised access to your account.
- ✓We will never ask for your password via email or phone.
- ✓We implement rate limiting, JWT authentication, and encrypted storage, but we cannot guarantee absolute security.
5. Subscription & Billing
- •Subscription plans are billed in advance on a monthly or annual basis.
- •Payments are non-refundable except as required by applicable law.
- •We reserve the right to modify pricing with 30 days' prior notice.
- •Failure to pay may result in suspension or termination of your account.
- •Downgrading your plan may result in loss of access to features above your new plan's tier.
6. Termination & Data Deletion
Upon account termination (voluntary or by us), your data will be retained for 30 days after which it will be permanently deleted from our systems, except where retention is required by law (e.g., financial records retained for 7 years under the IT Act).
- •Identity proof documents are automatically purged 6 months after a tenant's exit date.
- •You may request immediate deletion by contacting support.
- •We reserve the right to terminate accounts that violate these Terms without notice.
7. Limitation of Liability
To the maximum extent permitted by Indian law, Stayva shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, tenant data, or business opportunity. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
8. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India. Before initiating legal proceedings, the parties agree to attempt resolution through good-faith negotiation for at least 30 days.
9. Changes to Terms
We may update these Terms at any time. If we make material changes, we will notify you via email or an in-app notification at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
